Copyright Usage Agreement - Oregon Realty Photos LLC

By booking a photography session with Oregon Realty Photos LLC ("Photographer") and submitting prepayment through our online scheduling system, you ("Client") agree to the following terms regarding the use of photographic images ("Photos") provided by the Photographer.

1. Grant of License

- Upon delivery of the Photos, the Photographer grants the Client a limited, non-exclusive, non-transferable license to use the Photos solely for marketing the property located at the address provided during booking ("Property") for sale.

- Permitted use includes online real estate listings, printed marketing materials (e.g., flyers, brochures), and social media posts directly related to promoting the sale of the Property.

2. Term and Expiration

- This license begins when the Photos are delivered to the Client and expires automatically upon the earliest of:

a. The sale of the Property (transfer of title);

b. The Property being withdrawn from the market; or

c. The expiration of the Client’s listing contract for the Property.

3. Ownership and Photographer’s Rights

- The Photographer retains full copyright ownership of the Photos at all times.

- The Photographer reserves the unrestricted right to use, license, or resell the Photos to other parties at any time, including after this Agreement expires, for any purpose (e.g., stock photography, portfolios, or marketing), without notice to the Client.

4. Payment

- Full prepayment is required prior to scheduling a photo shoot or prior to the release of the images. The fee, as listed on the Photographer’s website at the time of booking, covers the photo shoot and the limited usage rights described herein. No refunds will be issued for completed shoots.

5. Restrictions

- The Client may not transfer, sublicense, or assign usage rights to any third party without the Photographer’s written consent.

- Use of the Photos for purposes other than marketing the Property for sale, or after the license expires, is prohibited and constitutes copyright infringement. The Client agrees to indemnify the Photographer for any damages resulting from unauthorized use.

6. Modifications

- The Client may not edit, alter, or manipulate the Photos without the Photographer’s written permission, except for minor resizing or cropping necessary for marketing purposes.

7. Governing Law

- This Agreement is governed by the laws of the State of Oregon. Any disputes will be resolved in a court of competent jurisdiction in Clackamas County, Oregon.

8. Acceptance

- Booking a photo shoot and submitting prepayment through the Oregon Realty Photos LLC website constitutes the Client’s acceptance of this Agreement in its entirety.
